Website Terms of Service

1. General provisions

These Terms of Service set out the rules for using the website available at svisuals.pl (hereinafter: the “Website”), operated by a natural person conducting business under the name SVISUALS with its registered office at ul. 1 Maja 21, 42-217 Częstochowa (hereinafter: the “Service Provider”).

Use of the Website signifies acceptance of these Terms of Service. The Terms of Service are made available free of charge via the Website in a form that allows downloading, saving and printing.

The Website provides services by electronic means within the meaning of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2020, item 344 as amended).

2. Definitions

  • User - a natural person, legal person or organisational unit using the Website.
  • Account - a set of data and functionalities available after registration and login on the Website (Client Panel).
  • Editing Services - video post-production services provided by the Service Provider on an individual order basis.
  • Equipment rental - temporary provision of film equipment from the Website catalogue under the conditions specified in the Terms of Service.
  • Shop - a section of the Website enabling the purchase of digital products (editing packs: SFX effects, animations, transitions, presets, etc.).
  • Digital Product - a file or set of files in electronic form made available to the User after purchase.
  • Order - a declaration of intent by the User aimed at concluding a contract for the provision of a service or purchase of a product.
  • Security deposit - a refundable security amount charged when renting equipment from Users who are not verified companies.

3. User Account

Registration of an Account on the Website is free and voluntary. An Account is required to use equipment rental, purchase digital products in the Shop, and access the Client Panel.

The User may create an Account using the registration form (email + password), login via email link (Magic Link), one-time email code (OTP) or login via an external identity provider (Google, Discord).

The User undertakes to provide truthful data and not to share login details with third parties. The User is responsible for all actions carried out via their Account.

The Service Provider reserves the right to suspend or delete an Account in case of violation of the Terms of Service, provision of false data or actions detrimental to the Website or other Users.

The User may delete their Account at any time by contacting the Service Provider at kontakt@svisuals.pl. Deletion of the Account does not affect contracts and obligations already concluded.

4. Video editing services

4.1. Order

Ordering editing services is done via the form on the /zamow page or by direct contact with the Service Provider. The User describes the project scope (brief). For enquiries sent via an Account, the Service Provider prepares an individual quote within less than 24 business hours. For enquiries without an Account, this deadline is not guaranteed.

4.2. Contract conclusion

The contract for the provision of editing services is concluded when the User accepts the quote and makes an advance payment (if required). Detailed terms (scope of work, deadline, price, number of revision rounds) are agreed individually and confirmed by email or in a separate contract.

4.3. Execution and revisions

The Service Provider performs the editing in accordance with the agreed scope and deadline. The standard offer includes 2 rounds of revisions. Additional revisions beyond the agreed scope may be priced separately.

4.4. Material delivery

The User undertakes to provide source materials (video, audio, graphics files) within the agreed deadline. Delay in providing materials may result in postponement of the completion date.

4.5. Rights to materials

The User declares that they hold rights to the materials provided for editing or possess appropriate licences. The Service Provider is not liable for infringement of third-party rights resulting from materials supplied by the User.

5. Equipment rental

5.1. Reservation

Equipment reservation is made via the cart on the /wynajem page. The User selects equipment, rental period and collection method (personal pickup in Częstochowa, courier or InPost Parcel Locker).

5.2. Reservation paths

Companies verified in the VAT register (after NIP verification) may pay for rental online via Stripe (card, BLIK, Przelewy24) without a security deposit, up to the amount of 5,000 PLN. Other Users submit a rental enquiry - the Service Provider contacts within 24 hours with confirmation of availability and payment terms.

5.3. Security deposit

The security deposit is a refundable guarantee charged upon equipment collection from Users who are not verified companies. The amount of the deposit is indicated for each piece of equipment. The deposit is fully refunded after the equipment is returned in an undamaged condition. Companies verified in the VAT register are exempt from the deposit.

5.4. Responsibility for equipment

The User bears full responsibility for the rented equipment from the moment of collection until return. In case of damage, destruction or loss of the equipment, the User undertakes to cover the costs of repair or purchase of equivalent equipment.

5.5. Equipment return

The equipment must be returned by the agreed deadline, in a condition not deteriorated beyond normal wear and tear. Late returns will incur a charge for each additional day according to the daily rate.

5.6. Price list

The rate for the first day of rental constitutes the full daily rate. From the second day onwards, a 50% discount applies. When renting a camera and lens simultaneously, an additional 10% discount applies. Current prices are listed with each piece of equipment on the /wynajem page.

6. Shop - digital products

6.1. Offer

The shop offers ready-made editing packs (SFX effects, animations, transitions, presets, overlays, music and others) in downloadable file form. The description, contents and price of each product are provided on the /sklep page.

6.2. Purchase and delivery

Purchasing a digital product requires having an Account. After payment is made, the product is immediately available for download in the Client Panel (section "My packs"). The User has permanent access to purchased products.

6.3. Licence

Purchasing a digital product grants the User a non-exclusive, perpetual licence to use the purchased files in commercial and non-commercial projects. The licence includes:

  • Use in video projects (YouTube, advertisements, corporate films, etc.)
  • Use in the User's clients' materials (e.g. as part of editing services)
  • Modification of files for project purposes

The licence does not include:

  • Resale, redistribution or sharing of files with third parties in unchanged form
  • Inclusion of files in other packs/sets intended for sale
  • Claims of copyright to the source files themselves

6.4. Withdrawal from the contract - digital products

In accordance with Article 38 point 13 of the Consumer Rights Act, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, if performance has begun with the consumer's express consent before the withdrawal period has expired and after the trader has informed the consumer of the loss of the right of withdrawal.

By purchasing and downloading the product, the User consents to the immediate commencement of performance and acknowledges the loss of the right to withdraw from the contract.

7. Payments

Payments on the Website are processed via the payment operator Stripe (Stripe Payments Europe, Ltd.). Available payment methods: payment card, BLIK, Przelewy24.

All prices listed on the Website are gross prices expressed in Polish zloty (PLN), unless explicitly stated otherwise.

The Service Provider issues VAT invoices upon User request. To receive an invoice, please provide invoice details in the order form or contact by email.

The maximum amount for a single online transaction (equipment rental) is 5,000 PLN. Orders exceeding this value are processed after direct contact with the Service Provider.

8. Complaints and withdrawal from the contract

8.1. Complaints

Complaints regarding services or products can be submitted by email to kontakt@svisuals.pl or via the Support form in the Client Panel.

The complaint should include: User details, description of the problem, date of occurrence and expected resolution method. The Service Provider will consider complaints within 14 days of receipt.

8.2. Withdrawal from the contract (services)

The consumer has the right to withdraw from a service contract within 14 days of concluding the contract, without giving any reason, unless the service has been fully performed with the consumer's express consent.

The withdrawal statement should be sent to the address kontakt@svisuals.pl. In the case of partial performance of the service, the consumer bears costs proportionate to the scope of work completed.

8.3. Refunds

In the event of effective withdrawal from the contract, the Service Provider will refund the payment received within 14 days using the same payment method used by the User.

9. Liability

The Service Provider exercises due diligence to ensure the proper functioning of the Website but does not guarantee its uninterrupted and error-free availability.

The Service Provider is not liable for:

  • Service interruptions due to technical reasons, maintenance or force majeure.
  • Consequences of the User providing false or incomplete data.
  • Violation of the rights of third parties resulting from materials provided by the User.
  • Loss of data resulting from circumstances beyond the control of the Service Provider.
  • Actions of third parties, including payment operators, postal and courier service providers.

The liability of the Service Provider towards Users who are not consumers is limited to the value of the order to which the claim relates.

10. Intellectual property

The Website, its content, graphic layout, logo, texts, graphics, software and other elements are the property of the Service Provider or its licensors and are protected by copyright and industrial property law.

Copying, distributing, modifying or using the content of the Website without the written consent of the Service Provider is prohibited, except for permitted personal use and licences granted for digital products (point 6.3).

Video materials produced as part of the editing service are the property of the User (the ordering party), unless the contract provides otherwise. The Service Provider reserves the right to use excerpts from the production in its portfolio, unless the User expressly prohibits this or an NDA has been concluded.

11. Personal data protection

Detailed information regarding the processing of personal data is contained in the Privacy Policy , which is a separate document available on the Website.

Users' personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Act of 10 May 2018 on the protection of personal data.

12. Changes to the Terms of Service

The Service Provider reserves the right to change the Terms of Service at any time. Users with an Account will be informed of significant changes by email or via a message in the Client Panel at least 14 days in advance.

Changes do not affect orders placed before they come into effect. Continued use of the Website after the changes come into effect constitutes acceptance of them.

13. Final provisions

Matters not regulated by these Terms of Service shall be governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on the provision of electronic services.

Any disputes between the Service Provider and a consumer may be resolved amicably before the competent arbitration court or via the European Commission's ODR platform available at ec.europa.eu/consumers/odr .

Disputes with Users who are not consumers shall be resolved by the court competent for the Service Provider's registered office.

The Terms of Service come into effect on 27 June 2026.
